Which Debts Aren’t Discharged After Filing For Bankruptcy?

While Chapter 7 bankruptcy offers a fresh start by eliminating a significant portion of your debt, it’s important to understand that not all debts can be discharged. Some of the debts that are typically not discharged in a Chapter 7 bankruptcy include:

  • Student loans: Student loans are one of the most common types of debt that individuals seek relief from, but they are notoriously difficult to discharge. Courts often require proof that repaying the loans would cause you and your dependents to live in poverty for a significant portion of the repayment period.
  • Child support and alimony: Debts related to child support and alimony are considered priority debts and cannot be discharged through bankruptcy. These obligations are designed to help ensure the financial welfare of children and former spouses and are therefore protected.
  • Taxes: Certain tax debts are nondischargeable in Chapter 7 bankruptcy. Recent property taxes and income taxes for the past few years usually cannot be discharged. However, older tax debts might be eligible for discharge if specific conditions are met, such as the taxes being due more than three years ago and you have filed a return for them.
  • Debts incurred through fraud: If a debt was incurred through fraudulent activities, it would not be discharged in bankruptcy.   • Certain homeowners association (HOA) fees: If you own a property with HOA fees, any fees assessed after you file for bankruptcy may not be dischargeable. These are ongoing obligations tied to property ownership.
